Terms and Conditions for Apartment Bookings (Vaganza)

1. Introduction
Welcome to Vaganza. These Terms and Conditions (“Terms”) govern your use of our website and booking platform, including all reservations made through:

By accessing our website and/or making a booking, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree with these Terms, you must not proceed with a booking.
2. Definitions
For the purpose of these Terms:
Client / You / Your: The person making the booking and/or staying at the property.
Company / We / Us / Our: Vaganza and its representatives, staff, contractors, and agents.
Apartment / Property: The accommodation booked through our platform.
Booking: Any confirmed reservation for an Apartment, including payments and related communications.
Stay: The period between check-in and check-out.
Agreement: These Terms, plus any apartment-specific rules communicated to you.
3. Booking Process
a. Booking Confirmation
All bookings are subject to availability.
A booking is only considered confirmed once you receive an official booking confirmation email from us.
We reserve the right to refuse any booking at our discretion.
b. Accuracy of Information
You must provide accurate and complete information when making a booking. Failure to do so may result in cancellation without refund.
c. Minimum Age Requirement
The person making the booking must be at least 18 years old.
4. Payment Terms
a. Pricing
All prices are displayed in EUR (€) unless otherwise stated.
Prices include applicable taxes unless stated otherwise.
Prices may vary depending on seasonality, demand, or availability.
b. Payment Schedule
Payment must be made in full or in accordance with the payment schedule displayed during the booking process.
If payment is not completed by the required deadline, the booking may be cancelled automatically without further notice.
c. Security Deposit / Damage Deposit
We may request a security deposit or perform a pre-authorisation on your card prior to arrival.
This deposit may be retained partially or fully if:
damage occurs,
excessive cleaning is required,
rules are breached,
items are missing,
late check-out occurs without approval.
d. Chargebacks
If a chargeback is initiated without valid reason, you remain liable for:
the full booking amount,
any unpaid balance,
administrative fees,
chargeback and banking fees.
5. Cancellation and Refund Policy
Cancellation conditions apply individually to each booking as shown during checkout and booking confirmation.
Unless otherwise stated, the following policy applies:
a. Cancellation by the Client
More than 30 days before arrival: full refund.
Between 30 days and 14 days before arrival: 75% refund (25% cancellation fee).
Less than 14 days before arrival: no refund.
All cancellation requests must be made in writing via email to:
The cancellation date is the date the email is received.
b. No-Show / Early Departure
No refunds are provided for no-shows.
No refunds are provided for early departures.
c. Cancellation by the Company
We reserve the right to cancel a booking if:
the property becomes unavailable due to unforeseen circumstances,
safety or maintenance issues arise,
there is suspicion of fraudulent activity,
the Client breaches these Terms.
In such cases, we will offer either:
a full refund, or
alternative accommodation (if available).
6. Check-in, Check-out, and Access
a. Check-in / Check-out Times
Check-in and check-out times are stated in the booking confirmation.
Early check-in and late check-out requests are subject to availability and may incur additional charges.
b. Identity Verification
You may be required to provide:
a valid passport or ID card,
guest details for all occupants.
Failure to provide requested identification may result in refusal of entry without refund.
c. Self Check-in
Most apartments use self check-in systems. You must follow the instructions provided. Loss of keys or access codes may result in additional fees.
7. Guest Rules and Responsibilities
a. Maximum Occupancy
You must not exceed the maximum guest number stated in your booking confirmation.
If additional guests are found on-site, we reserve the right to:
cancel the booking immediately without refund, and/or
charge additional guest fees.
b. Noise and Disturbance
Guests must respect neighbours and avoid excessive noise, especially during night hours.
If complaints are received (including police involvement), we may terminate the booking immediately without refund.
c. Smoking Policy
Smoking is strictly prohibited inside the apartment unless explicitly stated otherwise. If smoking occurs indoors, additional cleaning and deodorising fees will apply.
d. Parties and Events
Parties, gatherings, and events are strictly prohibited unless explicitly authorised in writing.
e. Pets
Pets are not allowed unless explicitly stated in your booking details.
f. Cleaning Standards
The apartment must be left in a reasonable condition. Excessive cleaning may result in additional charges.
8. City Tax / Eco Contribution
Where applicable, guests may be required to pay a mandatory government eco tax or city tax as per Maltese law.
This fee may be collected:
at check-in,
during the booking process,
or at check-out.
Failure to pay may result in refusal of access or additional charges.
9. Property Damage and Missing Items
You are responsible for all damage, breakages, missing items, and rule breaches during your stay, including those caused by any guest within your group.
We reserve the right to charge repair/replacement costs including labour, loss of revenue (if applicable), and administration fees.
10. Liability and Disclaimer
a. Limitation of Liability
To the maximum extent permitted by law:
we are not liable for loss of personal belongings,
theft, damage, or injury occurring during the stay,
accidents occurring inside or outside the property,
disruptions caused by utilities, construction, weather, or third-party service providers.
b. Maximum Liability Cap
If liability is proven, our total liability is limited to the amount paid for the booking.
c. Force Majeure
We are not responsible for failure to perform obligations due to events outside our control, including but not limited to:
natural disasters,
pandemics,
government restrictions,
strikes,
war,
utility outages,
infrastructure failures.
11. Maintenance and Repairs
We may access the property during your stay if necessary for:
urgent repairs,
safety inspections,
emergencies,
maintenance required to protect the property.
We will attempt to notify you in advance when possible.
12. Website Use and Content
All website content (logos, text, photos, design, and branding) is owned by Vaganza or its licensors.
You may not copy, reproduce, distribute, or reuse any content without written permission.
13. Privacy and Data Protection
We process personal data in compliance with the General Data Protection Regulation (GDPR) and Maltese law.
Your data may be shared only where necessary with:
payment processors,
booking management systems,
government authorities (where required by law),
service providers involved in guest check-in and verification.

14. Reviews and User Content
If you submit reviews, comments, or content, you grant Vaganza a non-exclusive right to use, display, and reproduce this content for marketing purposes.
We reserve the right to remove inappropriate or false content.
15. Changes to Terms
We may update these Terms at any time. Updates will be published on our website with a revised “Last updated” date.
Your continued use of the website and services constitutes acceptance of any updated Terms.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of Malta and applicable European Union regulations.
Any disputes shall be subject to the exclusive jurisdiction of the Maltese Courts.
